 Puppy Contract

1. DESCRIPTION OF DOG

The dog sold pursuant to the terms of this agreement is as follows:

2. SELLER'S REPRESENTATIONS

The following representations and conditions apply to the sale of the aforementioned dog:

As of the date of this agreement, the dog is in good health and free of communicable diseases.

Vom Mystical Haus certifies that upon delivery, the puppy/dog is in good health and has been immunized and wormed according to the attached health record.

The Buyer has 72 hours to have dog examined by a veterinarian and to personally inspect the dog. Any claims must be made within this time period and will be verified by Seller's own veterinarian.

Buyer is completely satisfied with and waives any and all claims regarding the dog's conformation, and outward appearance (meaning the dog meets the breed standard at this age).

 3. CONSIDERATION

One of the following options may be used:

1. This dog, identified in Section 1, is being sold for the sum of $_____________, to be paid in full on M_____D_____Y_____.

2. A deposit of ___________ on ____________, with the balance of ___________ to be paid before the receipt / shipment of puppy.

THERE ARE NO REFUNDS OF ANY KIND.

4. STIPULATIONS (Pet puppies and Working / Breeding )

             _____ This puppy/dog is being sold for use as a family pet.

This Dog/Puppy is being sold on an AKC Limited registration. And is to be spayed/neutered by eighteen (18) months of age. If said dog is over eighteen (18) months of age, you will have thirty (30) days to spay/neuter the dog. It is the new owners responsibility to set up the date and time with their Veterinarian and to assume all financial responsibility for all services done to said canine. A statement from your veterinarian showing where this has been done must be remitted to Vom Mystical Haus Shepherds.

_____ This dog or bitch has been graded to be Working  quality (Schutzhund, AKC, SAR, Obedience, Police or Breeding).

All Working/ Breeding puppies will be sold with Full AKC Registration.

Bitches and Studs shall be bred ONLY after the age of two years and having been OFA’d receiving at least a Fair score or there may be  PennHIP evaluations at no less than 18 months of age with a score of. X-rays taken or submitted before the 12th month from the date of birth will not be of consideration. The preliminary films must be submitted to OFA at 1 year of age or films must be submitted to PennHIP. A copy of the results must be sent to Vom Mystical Haus for our records.

(Both Pet and Working / Breeding )Pictures are to be sent at 6 months, 12 months, 18 months and 24 months.

If buyer chooses to sell dog/bitch or otherwise place him/her elsewhere, Seller gets first chance to re-acquire dog/bitch.

 At NO time should this puppy/dog  go to a Shelter or Pound!

5. MAINTENANCE ( Both Pet and Working / Breeding )

Buyer agrees to maintain this dog in good health, provide routine preventative health care including, but not limited to, inoculation, internal and external parasites, and heartworm preventative medication.

Buyer further agrees to provide proper exercise as indicated in order to maintain this dog or bitch in proper weight and physical condition. A proper diet consists of top-quality dog food and supplements. Vitamin E is an acceptable preservative.

Buyer agrees that this dog or bitch is NOT to be LEFT IN A BACKYARD OR KENNEL ONLY. This dog or bitch is sold with the understanding that it was to go to carefully selected parties and that Buyer AVOWED the dog or bitch would become a member of the family. (This is to assure proper development and maintenance of the temperament for which the animal was bred.)

6. WARRANTY (Pet or Working/Breeding)

X-ray films of the pups hips/elbows, showing proper positioning, and meeting OFA standards, must be submitted to OFA for Preliminary evaluation at the owner’s expense, at one year of age.  A copy of the results must be sent to Vom Mystical Haus for our records. The said dog will be free from hip dysplasia of genetic origin at the age of two (2) years as determined by the Orthopedic Foundation for Animals(OFA) or PennHIP. X-rays taken or submitted before the 12th month from the date of birth will not be of consideration. The preliminary films must be submitted to OFA at 1 year of age or films must be submitted to PennHIP. The said dog cannot be active in Schutzhund, Agility or any jumping or slick floors, stairs, etc. that would cause injury to the hip area, This would void the warranty. In the event that a problem enumerated above, the buyer shall have the option to accept a replacement puppy of the same quality originally purchased or pay the difference for a higher priced puppy if desired . The replacement puppy will be selected by the breeder from the next available litter and delivered upon proof of Failing OFA score(meaning Moderate or Severe) or a PennHip score of more than  .55 on both hips. A copy of the report from OFA or PennHIP and also a photo or the actual X – ray films used to determine the grade must be provided to Vom  Mystical Haus. VMH reserves the right to a second opinion of the dog’s condition by a Veterinarian of our choice before the guarantee will be honored. This dog is only warranted for the purpose of being a companion dog. While it may be capable of performing other functions, no warranty is given as to its’ fitness for any special purpose. Buyer is responsible for all transportation of any puppy or replacement puppy.

7. TESTICLE GUARANTEE ( Working /Breeding )

If the male pup does not have both testicles down by the age of 6 months, the buyer can choose from the following options:

Return the pup and receive a replacement pup from the next available litter, not necessarily from the same breeding.

Keep the pup, and receive 1/2 off the price of a replacement pup of similar value from the next available litter, with proof of neuter.

 8. TRAINING REWARDS

Here at Vom Mystical Haus Shepherds we believe in the well trained German Shepherd Dog.

We offer these following Training Rewards for you and your dog's accomplishments:

1.  $25.00 reward will be given for a CGC or TDI Certification.

2.  $50.00 reward will be given for  a CD, Agility, FH or Schutzhund BH.

3.  $100.00 reward will be given for Certification as a SAR dog.

4.  $100.00 reward and a 20% discount on a future pup will be given for a Schutzhund 1 title or                                             Police Dog Certification. 

A copy of all certification documentations and a current photo of you and your dog must be submitted for reward redemption.

9. VIOLATIONS

If at any time this contract is violated in ANY way, the breeder has the right to reclaim the said dog. There will be NO compensation for the said dog/puppy or its’ belongings, training or puppies. Mental or physical abuse and or lack of proper care by the buyer will violate any warranties and violate this contract. Anyone not in compliance with this contract will be taken to court in the State and county where Vom Mystical Haus resides for non-compliance of a legal document. This procedure will include but not be limited to court cost, my time @ $25.00 /hr. and all Vet costs that may be needed for the animal.

Buyer agrees Seller will REPOSSESS DOG OR BITCH UPON EVIDENCE OF NEGLECT AND/OR ABUSE at no expense to the seller.

And finally...Buyer agrees that he/she understands this contract fully, and that this contract is under the jurisdiction of the State of North Carolina, in the county of ____Rowan______. It is agreed the place of venue shall be in __Rowan_ County, North Carolina.

10. CLOSING

If any of this agreement is or becomes void or unenforceable by force or operation of law, the other provisions shall remain valid and enforceable. The buyer hereby releases Vom Mystical Haus from any/all liabilities pertaining to the said puppy/dog. The entire Agreement between the parties is contained herein.
